Trenton, NJ (PRWEB) June 15, 2007 -- On Thursday, June 7, 2007, Renaissance Broadcasting Corporation (RBC), based on newly discovered evidence, filed a motion in the New Jersey State Appellate Court to nullify prior state court orders entered against RBC in Township of Waterford v. Renaissance Broadcasting Corporation, Docket Number A-2428-80T1 and Milstead, Receiver for Renaissance Broadcasting Corporation v. Township of Waterford Zoning Board, Docket Number A-1010-83T2. The proceedings were initiated against RBC in the Law Division of the Superior Court of New Jersey, Docket Number L-1116-80, on September 3, 1980. The prior appellate division judgments were entered on June 23, 1982 and August 5, 1985, respectively.
The June 7, 2007 motion alleges that the prior actions against RBC constituted a 27-year violation of Section 3 of the Civil Rights Act of April 20, 1871 by the State of New Jersey. The civil rights violations resulted in the loss of RBC's business and property. Governor Jon Corzine and Lisa B. Jackson, the Commissioner of the New Jersey Department of Environmental Protection (DEP), are named as indispensable party defendants.
The September 3, 1980 complaint was generated by municipal opposition to DEP's decision to lease land within the Wharton State Forest to RBC for the construction and operation of a television broadcasting transmission system and antenna tower.
The underlying bases for the earlier judgments against RBC were that the Wharton State Forest was not state-owned and regulated, municipalities have an interest in land within the Wharton State Forest and the lease agreement between DEP and RBC was "for purposes beyond the legislative purpose" of DEP.
However, according to Donald C. McMeans, founder and president of RBC, the new evidence which is comprised of two special reports and an out-of-print statute book, will prove conclusively that the underlying bases for the earlier judgments were absolutely false.
In 2004, prior to the recent discoveries, a bipartisan group of State legislators introduced joint resolutions AJR93 and SJR47 calling for an investigation of the roles played by New Jersey Deputy Attorneys General in the RBC case. The joint resolutions stated, "Judicial records indicate that Deputy Attorneys General, in the representation of the Commissioner of Environmental Protection, have subjected Renaissance Broadcasting Corporation to unlawful discrimination under the August 21, 1980 lease agreement and have impeded the administration of justice by refusing to perform statutorily mandated duties to prevent encroachment of the Township of Waterford upon the sovereign and exclusive authority of the Department of Environmental Protection to regulate the use of Wharton State Forest lands."
Lois B, Yates, lobbyist for RBC, states, "Former Governor James McGreevey intervened to prevent the resolution from coming to the floor by stating that he was going to take care of the matter administratively. However, his premature departure prevented fulfillment of his promise."
Due to the public trust involvement, RBC is requesting an order for the assignment of the New Jersey Public Advocate to conduct mediation proceedings to expedite a just resolution and to avoid unnecessary costs.
"Of course, if the parties do not agree to mediation, we will proceed with the trial," McMeans said.
